2. Terms and Conditions for [CES 2024 Business Meeting Program] and [Post CES 2024 Contact Program]

Welcome to the [CES 2024 Business Meeting Program] and [Post CES 2024 Contact Program] (each “Program” and jointly “Programs”) operated by Kia Corporation (“Kia”), a company that manufactures, and conducts sales, marketing and services for Kia brand automobiles. In order to participate in the Programs, participants (“Participant” or “you”) are required to make a Pre-Book([CES 2024 Business Meeting Program]) or provide their contact information([Post CES 2024 Contact Program]), and the Terms and Conditions (“Terms”) describe the process for participating in the Programs (“Process”). Please review the Terms carefully, which sets out your rights and obligations before registering for the Programs.

These Terms provide you with information on details on the Programs and instructions on how to cancel your participation request. Your acceptance and use of the Programs means that you agree to these Terms.

These Terms are not for the research, development, commercialization, sale, purchase, manufacture, or any type of agreement related to our concept cars or technologies introduced by Kia at CES 2024. After you agree to these Terms, we will arrange a business meeting or contact you to provide you guidance on the next steps to discuss future opportunities to cooperate with Kia based on our availability. Please note that Kia does not make any warranty of any kind in connection with these Terms or its subject matter to the maximum extent permitted by the applicable laws.

  1. Programs

    However, these Terms do not constitute any whole or part of a sales and purchase agreement or guarantee cooperation related to the research, development, commercialization, sale, purchase, manufacture, or any type of agreement related to the concept cars, displayed technologies, or any subsequent final production models.

  2. Eligibility

    You must be at least 18 years of age or the legal age as an adult of your country of residency in order to accept these Terms and to participate in the Programs.

  3. Participation Process

    Please provide the following information to participate in the Programs.

  4. Concepts and Displays

    Until such time as we notify you otherwise, the information, designs, technical specifications, and images used in pages of https://worldwide.kia.com/ and in communications are prototypes and may not reflect the final production vehicle.

    The final design, specifications, name, and branding of the final production vehicle may be different from the concepts and shall be determined at our sole discretion – we give no commitment to what it will consist of or include.

  5. Treatment of Personal Information

    Your personal information that we collect shall be saved in a database located in the Republic of Korea subject to the applicable laws and regulations. You have the right to access your personal information and request its deletion, correction, or any updates.

  6. Right to Cancel or Withdraw from the Programs

    You may cancel or withdraw from the Programs anytime at your choice. In order to cancel or withdraw from the Programs, you may send your cancellation to this email address before the meeting : [KIA_PBV@kia.com]

  7. Rights to Modify or Cancel Programs

    Kia reserves the right to change, update, improve, correct, modify, suspend, discontinue, or cancel all or part of the Programs.

  8. Rights to Decline or Cancel the Programs

    In case of over-subscription of the Programs, Kia reserves the right to suspend the Programs and to decline any additional participation thereafter. Please note that your participation in this Programs shall be canceled if (i) you are not eligible for the Programs, (ii) you are in breach of any obligations stipulated in the Terms, or (iii) any other circumstances that prevent Kia from continuing the Programs.

  9. Limitation of Liability

    Please note that these Terms shall neither form the basis nor have any relation to any other agreements that you engage in with Kia or its affiliates. Kia shall not bear either liabilities or responsibilities for the damages incurred by actions or inactions of any third party, including Kia’s affiliates.

  10. Force Majeure

    Your participation in the Programs and/or your reservation does not create liability for Kia for any failure to perform due to an event beyond our control, including, but not limited to, any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, unavailability of materials, labor strike, earthquake, flood, pandemic or any other natural or man-made eventuality outside of our control.

  11. No Assignment

    You may not transfer or assign any benefits, entitlements or rights created under these Terms to any third party.

  12. Modification; Severability; Entire Agreement

    Kia reserves the right, at its sole discretion, to change these Terms at any time. If for any reason a court or any other authority of competent jurisdiction finds any provision, or portion thereof, to be invalid, void or unenforceable for any reasons, the remainder of the Terms shall continue in full force and in effect, and the invalid, void or unenforceable provision shall be deemed to be modified solely to the extent necessary to make it valid, effective and enforceable. These Terms represent the entire agreement governing your participation in the Programs.

  13. Governing Law and Dispute Resolutions

    These Terms, the subject matter and the formation herein, and any related non-contractual disputes or claims shall be governed by the laws of the Republic of Korea. All disputes, controversies, or differences which may arise between the Parties, out of or in relation to or in connection with this Terms, or for the breach thereof, shall be finally settled by arbitration in Seoul, South Korea in accordance with the International Arbitration Rules of the Korean Commercial Arbitration Board. The arbitration proceedings and resulting decision shall be made in English. The award rendered by the arbitrator(s) shall be final and binding on the Parties concerned.
